More than one month has passed since AFAD’s Chairperson was arrested in Srinagar.

During this month-long detention, Indian authorities have ignored the decision of a judge ordering Khurram Parvez‘s release and tried their best to make his access to family and legal counsel very difficult.

Last week, the case was delayed again as Indian authorities failed to present a response to the petition filed before the Registry of the Jammu and Kashmir High Court, challenging Khurram’s detention.

The case is now scheduled for hearing by the court on October 25, more than 10 days from today. We hope and pray that there will be no third postponement of the already delayed hearing.

In the meantime, the place of our Chairperson is still empty.

The Indian authorities must immediately and unconditionally release Kashmiri human rights defender Khurram Parvez, who has been placed in administrative detention in Jammu and Kashmir.

Khurram Parvez is the Programmes Coordinator of Jammu Kashmir Coalition of Civil Society (JKCCS), as well as the Chairperson for the Asian Federation against Involuntary Disappearances, a collective of 13 non-governmental organizations from ten Asian countries. JKCCS has extensively documented and litigated on human rights violations in Jammu and Kashmir.

He was arrested on 16 September and placed in administrative detention in Kupwara in Srinagar, for allegedly posing an imminent threat of ‘breach of peace’. On 20 September, a court in Srinagar ordered Khurram Parvez to be released after ruling that the executive official who ordered the detention had not followed necessary procedures, including by failing to adequately explain the grounds for his detention.

As soon as Khurram Parvez was released, he was again detained and transferred to a police station in Srinagar. He is currently being held in administrative detention under the Jammu and Kashmir Public Safety Act (PSA) at the Kot Bhalwal Jail in Jammu. The PSA detention order was based on a police report which states that Khurram Parvez had instigated violence in four previous cases; however, none of the First Information Reports in the four cases actually mention him by name.

Today is the 30th day of the continuing arbitrary, unjust and illegal detention of Parvez. Robert F. Kennedy Human Rights is deeply disappointed and outraged by this continuing violation of the rights of Mr. Parvez.

Khurram Parvez was arrested on September 16th. In the course of this month-long detention, Khurram Parvez has been illegally arrested. The Court’s decision ordering his release has been blatantly ignored. Instead, he had been transferred to two different prisons – first in the Kupwara sub-jail and then in Kot-Bhalwal, in Jammu – further away from his family and legal counsel. With his physical disability, the jail conditions do not accommodate his special needs adequately.

Every minute of Mr. Parvez’s detention is time wasted. Violation of his right to liberty is injustice to Khurram, to his family, to the Kashmiri society and to the global struggle against enforced disappearances and against human rights violations. India should fully understand that prolonging Mr. Parvez’s detention does not silence Khurram, but instead, strengthens him and the global protest against the world’s self-proclaimed largest democracy.

We urge the Indian authorities to drop all charges against Khurram Parvez and abide by their international obligations under human rights law, as well as their own domestic law.
